funke is a date-planning app operated by Wynwood Technologies LLC ("Wynwood Technologies", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the funke mobile app, the website funkedate.com, and any related services (together, "funke"). For funke on the Apple App Store, these Terms are also the end user license agreement.
By creating an account or using funke, you agree to these Terms. If you do not agree, do not use funke. Our Privacy Policy explains how we handle your information.
Questions: admin@wynwoodtechnologies.com
You must be at least 18 years old, and old enough to form a binding contract where you live, to use funke. By using funke, you confirm that you meet these requirements and that no law prevents you from using it. If we learn that someone under 18 has an account, we will close it and delete its data.
Each account is for one person. You may not create an account for someone else or share your account.
You sign in to funke with Sign in with Apple or Sign in with Google. You are responsible for keeping access to that sign-in account secure and for everything that happens under your funke account. Tell us right away at admin@wynwoodtechnologies.com if you think someone else has accessed your account.
Keep the information you give us, such as your name, city, and preferences, accurate. funke uses it to generate your date ideas.
Notifications. If you allow notifications, funke may send you date reminders, partner activity alerts (for example, when your partner plans a surprise date or unlinks), and a weekly suggestion to plan a date. You can turn these off in Settings or in your device settings.
funke lets you link your account with one partner's account using a join code.
If you feel unsafe with a partner, unlink in Settings and contact local support services. You can also email us to close your account.
funke uses artificial intelligence, including Claude models provided by Anthropic, along with third-party data from sources such as Google Places, Ticketmaster, and Viator, to generate date ideas. Artificial intelligence can make mistakes, and third-party data can be out of date. A date idea might name a venue that has closed, list the wrong hours or prices, describe an event that is sold out or cancelled, or suggest something unsuitable for you.
Because of that:
Prices and costs shown in funke are estimates and may differ from what a venue or partner actually charges.
Venues, events, experiences, and websites that funke suggests or links to are run by third parties, not by us. We do not own, operate, control, or endorse them.
Some links in funke, such as "Book this experience" or "Get Tickets", are affiliate links. If you make a purchase after tapping one, we may earn a commission at no extra cost to you. We choose date ideas based on fit with your preferences, budget, and location, not on which partner pays a commission. See Section 5 of our Privacy Policy for our current partners.
Any booking or purchase you make is between you and that third party, under its own terms, prices, cancellation rules, and privacy policy. Questions about a booking, refund, or event go to that third party.
funke uses Google Maps features and content. Your use of that content is subject to the Google Maps / Google Earth Additional Terms of Service and the Google Privacy Policy.
funke gives you a limited number of free refreshes (new sets of date ideas) each week. Refresh credits:
We may change how free refreshes work for legitimate reasons, as described in Section 14.
funke does not charge for anything today. If we offer paid features in the future, such as extra refreshes or a subscription:
When using funke, you agree not to:
"Your content" means information you enter into funke, such as your name, city, preferences, ratings, and notes.
You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display your content to operate, provide, secure, and improve funke, to share it with your linked partner, and to publish date ideas on our website as described below. This license ends when your content is deleted, except as described below.
Date ideas on our website. Date ideas that funke generates for you may be copied, with names, account identifiers, and precise location removed, and published on our website, for example on city pages. We take reasonable steps to remove anything that could identify you. These copies are not tied to your account and may stay published after you delete it. If you think a published idea identifies you, email us and we will remove it.
Feedback. If you send us suggestions or ideas about funke, we may use them without paying you or owing you anything.
You confirm that you have the right to share the content you enter, and that it does not break these Terms or anyone else's rights.
funke, including the app, website, design, text, graphics, logos, and the "funke" name, belongs to Wynwood Technologies or its licensors and is protected by intellectual property laws. As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use funke for your own non-commercial use. We keep all rights not expressly granted.
Generated date ideas. As between you and us, we do not claim ownership of date ideas generated for you, and you do not gain ownership of them. Similar or identical ideas may be generated for other users. You may use the date ideas funke gives you for any personal purpose, and you give us permission to use generated date ideas as described in Section 10.
Copyright complaints. If you believe content in funke or on funkedate.com infringes your copyright, email admin@wynwoodtechnologies.com with the work, where it appears, and your contact details.
Our Privacy Policy explains what information we collect, how we use it, and your rights, including how to delete your account. Please read it. It is not part of these Terms.
If you downloaded funke from the Apple App Store, these additional terms apply:
If these Apple terms conflict with anything else in these Terms, these Apple terms control for funke downloaded from the App Store.
You can stop using funke at any time and delete your account in Settings using "Delete Account", or by emailing us. When you delete your account, we delete your profile, preferences, and the dates and feedback that belong only to you. Some information is kept: (a) if you are linked, dates, ratings, and notes you shared with your partner stay in your partner's account; (b) date ideas on our website, as described in Section 10; and (c) a limited record needed to prevent abuse of free refreshes, as described in our Privacy Policy.
We may suspend or close your account, or limit your access, if you break these Terms, if the law or a court requires it, or if we reasonably believe your use is causing harm to other users, to third parties, or to the security of funke. Where reasonable, and unless the law or a security risk prevents it, we will tell you why and give you a chance to respond.
Changes to funke. We may change, add, or remove features for legitimate reasons, such as improving funke, responding to user feedback, security, legal requirements, or changes from our service providers. If a change materially reduces your access to or use of funke, we will tell you in advance where reasonably possible, and you may delete your account. If we stop offering funke entirely, we will give at least 30 days' notice unless that is not possible for legal or security reasons.
Sections 5, 6, 7, 10 (date ideas on our website and feedback), 11, 13, and 15 through 22 continue to apply after your account ends.
TO THE FULLEST EXTENT THE LAW ALLOWS, FUNKE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT FUNKE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATE IDEAS, VENUES, EVENTS, PRICES, OR OTHER INFORMATION WILL BE ACCURATE, COMPLETE, AVAILABLE, SAFE, OR SUITABLE FOR YOU.
If you are a consumer outside the United States, Section 20 explains how this section applies to you.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for gross negligence or intentional misconduct.
SUBJECT TO THAT, AND TO THE FULLEST EXTENT THE LAW ALLOWS:
If you are a consumer outside the United States, Section 20 explains how this section applies to you.
If you live in the United States, you agree to reimburse Wynwood Technologies for reasonable losses and legal costs arising from a third-party claim caused by your intentional or unlawful misuse of funke or your violation of someone else's rights. We will tell you promptly about the claim, and we control its defense. This section does not apply if you live outside the United States.
Talk to each other first. Before either of us starts a formal claim, the one bringing it will send the other a written notice describing the issue and the outcome wanted. Send yours to admin@wynwoodtechnologies.com. We will send ours to the email on your account. Both of us will try in good faith to resolve it within 60 days. Any deadline to bring the claim is paused during those 60 days.
Courts. If we cannot resolve the dispute informally, either of us may bring it in court:
These Terms are governed by the laws of the State of Florida, United States, and applicable United States federal law, without regard to conflict-of-law rules.
If you are a consumer who lives outside the United States, this choice of Florida law does not take away the protection of mandatory consumer laws of the country where you live.
European Union, European Economic Area, Switzerland, and United Kingdom. If you are a consumer who lives in one of these places:
(a) Sections 15, 16 (except its first paragraph), and 17 do not apply to you;
(b) we are liable under the statutory rules of your country for damage caused intentionally or by gross negligence, for death or personal injury, and under mandatory product liability law;
(c) for ordinary negligence, we are liable only for breach of essential contractual obligations, limited to damage that was typical and foreseeable when you accepted these Terms; and
(d) you keep your statutory rights if funke does not conform to the contract.
Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies those guarantees or any other right you have under the Australian Consumer Law. Where we are allowed to limit our liability for failure to meet a guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
We may update these Terms to reflect changes to funke, to the law, or to how we run our business. When we do, we will change the "Last updated" date at the top. If a change is material, we will tell you in the app or by email at least 30 days before it takes effect, or sooner only where a change is required by law or needed to address a security risk. The notice will describe the change. If you do not agree, you can delete your account at no cost before the change takes effect. For material changes, we may ask you to accept the updated Terms in the app before you continue using funke.
